 TERMS AND CONDITIONS
- Interpretation
The definitions set out in the Schedule apply in these terms and conditions.Â
- Agreement to Terms and Formation of Contract
2.1 These terms and conditions together with those on the Wellness Questionnaire are the only terms and conditions upon which FIW is prepared to deal with the Participant and they shall govern the Contract to the entire exclusion of all other terms or conditions.
2.2 A Reservation Request submitted by the Participant shall be deemed to be an offer by the Participant to participate in the Retreat and no contract or obligation on FIW relating to the Retreat shall come into existence until FIW shall issue a Confirmation of Booking to the Participant. FIW shall endeavour to issue a Confirmation of Booking or a notice of cancelation relating to the Retreat to the Participant no later than the Due Date.
- YOUR WELLNESS
3.1 Whilst on the Retreat, don’t push Yourself too hard in class. Always listen to Your body and what it needs and stop if You are in pain.
3.2 While We believe that the Retreat can be beneficial in many ways, it is not intended to diagnose, prevent, or treat any medical condition, to ascertain the state of Your health, or to be used as a substitute for medical advice and We make no promise that the Retreat will provide therapeutic benefit or that any particular “wellness” objective will be achieved. Please consult a health professional before attending the retreat for advice on any injuries, conditions or illness that may affect your participation.
3.3 It is essential that You have fully and accurately completed, updated and returned to us the Wellness Questionnaire by the Due Date. Failure to do so may result in You not being permitted to participate in the retreat.
- Registration and Payment
4.1 You must make payment of the Retreat Fee in accordance with the details on Our Webpage. Full payment of the Retreat Fee must have been paid by the Due Date. Failure to make full payment by the Due Date may result in You not being permitted to participate in the Retreat and the cancellation of Your registration without a refund of any deposits paid.
4.2 A description of what services and experiences, the payment for which are included in the Retreat Fee, is set out on Our Webpage. You agree to pay Us in full, as an addition to the Retreat Fee, for any extras and items not so described, when, and in the format requested by Us.
- Eligibility
All Participants must be at least 18 years old.
- Cancellation and Refunds
6.1 Participant Cancellations: If the Participant wants to cancel the booking:- (a) after the deposit, or full payment, but before the Due Date, We will fully reimburse the Participant, (less a sum to cover our administration expenses) only if We can refill the Participant’s booking.
(b) after the Due Date, but the Registration Fee has not been paid in full, the full Registration Fee shall remain payable to Us and shall only be refundable to the Participant (less a sum to cover Our administration expenses) if we can refill the Participant’s booking.
6.2 FWI Cancellations: We reserve the right to cancel the Retreat before or after the Due Date due to insufficient registrations, natural disasters, other unforeseen circumstances or causes beyond our reasonable control. In such cases Participants will receive a full refund of all payments made to Us. Such refund will constitute Our total liability to You in such circumstances. You agree that We shall not be responsible for any other expenses or costs incurred by You such as (but not limited to) travel costs.Â
- Transfers and Substitutions
 Participants may request to:
- Transfer to a different Retreat (if available)
- Substitute another person in their place
This is strictly subject to Our approval and may involve an admin fee. Participants will be responsible for insuring that any permitted substitute has fully and accurately completed and returned to us Our Wellness Questionnaire as soon as possible, but in any event prior to attending the retreat.
- Travel Insurance
Each Participant must take out and maintain travel insurance before attending the Retreat. Such insurance coverage must include:
- Cancellation and/or interruption of the Retreat
- Emergency medical care
- Personal accident and personal liability
- Loss of personal property
- Travel delays and missed connections
Proof of insurance may be requested prior to participation in the Retreat.
- Health and Safety
9.1 Medical Conditions: Participants must fully and accurately complete and return to Us our Wellness Questionnaire, and must fully disclose any pre-existing medical conditions, allergies, or dietary restrictions prior to the Due Date. You must update Your answers to Our Wellness Questionnaire and to Your disclosures, should there be any relevant change prior to Your attendance at the Retreat. We reserve the right to decline Your participation if We deem the Retreat unsuitable for Your health condition.
9.2 Medical Assistance: We are not responsible for providing medical treatment or assistance. Participants are responsible for their own medical needs and must carry adequate medical insurance.
9.3 We assume no liability for medical or health-related incidents of a Participant during the Retreat.
9.4 Participants agree to follow all local health regulations, including COVID-related guidelines, while on the Retreat.
- Participant Conduct
10.1 Behaviour: Participants are expected to behave respectfully and courteously to other Participants, Us, and third parties. Any behaviour We deem disruptive or harmful may result in the Participant being asked to leave the Retreat without a refund.
10.2Â Compliance: Participants must comply with all local laws and regulations, as well as any rules or guidelines provided by Us.
10.3 You must not attend the Retreat if you have an infectious disease or infectious condition.
10.4 If You or any of Your guests suffers an accident or injury whilst on the Retreat, You must report it to Us immediately.
10.5 No pets are permitted at the Retreat.
- Liability
11.1 Assumption of Risk: You fully acknowledge that You participate in the Retreat at Your own risk. We are not liable for any injury, loss, or damage incurred during the Retreat, including travel to and from the Retreat.
11.2 Participation in Retreat activities, (such as yoga, hiking, swimming, excursions), involves inherent risks. By attending, You acknowledge and voluntarily accept these risks.
11.3 To the maximum extent permitted by law, We are not liable for:
- Personal injury, illness, or death
- Theft, loss, or damage of personal property
- Any harm that You suffer as a consequence of attending the Retreat, unless such harm is solely caused by our proven negligence.

11.4 You are fully responsible for the Retreat’s property, furniture and all the accessories and objects found within it. You must liaise and reimburse Us if any such item is damaged or broken by You.
11.5 Limitation of Liability: To the maximum extent permitted by law, Our liability for any claims arising out of this Agreement is limited to the amount of the Retreat Fee.
- Intellectual Property
All materials provided or presented by Us during the Retreat, including but not limited to written materials, photographs, and videos, are the intellectual property of Us and may not be reproduced or distributed without Our prior written consent.
- Force Majeure
We are not liable for delays, disruptions, or cancellations due to events beyond Our reasonable control, including but not limited to:
- Natural disasters
- War, terrorism, or civil unrest
- Strikes or governmental actions
- Pandemics or health emergencies
- Use of Likeness
You grant Us permission to use photographs, videos, or other recordings taken during the Retreat for promotional and marketing purposes. Participants who do not wish to be photographed or recorded must inform Us in writing before the Retreat.
- Governing Law
This Contract is under English law and any disputes will be decided only by the courts of the United Kingdom.
- Amendments
We reserve the right to amend these Terms and Conditions at any time. Any amendments will be communicated to Participants in writing.
- Â Entire Agreement
The Contract Documentation constitutes the entire understanding between You and Us and supersedes all prior oral or written communications.
- Additional Terms and Conditions
18.1 Nothing in this Contract is intended to create or will be construed as creating a joint venture, partnership, employer/employee or principal and agent relationship between You and Us.
18.2 You irrevocably consent to the exclusive jurisdiction of the courts located in England and Wales, in connection with any action arising out of or related to the Contract and waive any objection based on lack of personal jurisdiction, place of residence, improper venue forum non-convenience in any such action.
18.3. If any court having competent jurisdiction holds any provision of the Contract invalid or unenforceable in any respect, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions of the Contract shall continue in full force and effect.
18.4 The failure or delay of either party to exercise or enforce any right or claim does not constitute a waiver of such right or claim and shall in no way affect that party’s right to later enforce or exercise it, unless such party issues an express written waiver, signed by a duly authorized representative.
 18.5 You may not assign this Contract or any of Your rights or obligations hereunder.
18.6 Except as expressly specified herein, this Contract shall create rights and obligations only between You and Us and it does not create any rights for any other parties.
- Notices
We may send all notices under this Contract by email to the most recent email address You have supplied to Us. You can send notices to our email address shown in the Contract Documentation. Headings used in this Contract are for information and not binding.
The Schedule – Definitions
In these Terms and Conditions the following words shall have the following meanings.
“Acknowledgement of Reservation” The message sent by FIW to the Participant acknowledging the Participant’s reservation of a place on the Retreat and setting out the terms upon which such reservation is made;
“Confirmation of Booking” The document submitted electronically or in writing by FIW to the Participant confirming the Retreat is going ahead and the Participant’s participation in it;
“Contract” The agreement between FIW and the Participant to provide the services of the Retreat to the Participant and to provide any goods ancillary thereto;
“Contract Documentation” Each and all of Our Webpage, the Acknowledgement of Reservation, the Wellness Questionnaire and the Confirmation of Booking;
“Due Date” That date which is four weeks before the first day of the Retreat Period
“FIW” or “We” CPM Sourcing Limited, whose registered office is at ……………………, trading as Fitness Inspiration for Women; “Us” and “Our” shall have cognate meanings;
“Our Webpage” www.fitnessinspirationforwomen.com or such other webpage as We may designate from time to time;
“Participant” or “You” The person specified in the Contract Documentation requesting to attend the Retreat; “Your” shall have a cognate meaning;
“Reservation Request” The Request submitted, in any electronic, written or verbal form by the Participant to FIW to reserve a place or places on the Retreat;
“Retreat” That experience described on Our Webpage or such other elements of the experience as FIW may substitute for any of the elements so described;
“Retreat Fee” That sum set out by FIW on Our Webpage as the price payable for participation in the Retreat;
“Retreat Location” That site described by FIW in the Confirmation of Booking where the Retreat is to be held;
“Retreat Period” That period specified in the Confirmation of Booking during which the Retreat will take place.
“Wellness Questionnaire” The questionnaire relating to the Retreat, provided by FIW, to be completed by the Participant and returned to FIW.
